Tragic Incident: Toddler Falls From Third-Story Window in Foster City
Recently, in Foster City, an 18-month-old child fell from a third-story window and landed on the sidewalk. The young boy was walking with his mother in their apartment when he stopped to look through an open window. The floor-height window's screen gave way, and the child tumbled out to the ground below.
When the fire department arrived at the Water’s Edge Apartments, they found the toddler unconscious but still breathing. The child was flown via helicopter to Stanford University’s trauma center. He sustained serious injuries that were consistent with a fall.
Premises Liability ActionResidential and commercial property owners are responsible for the safety of those that inhabit or visit a dwelling. When unfortunate accidents occur, it is important to hold those owners accountable for serious injuries or even death.
At the law office of Corsiglia McMahon & Allard, L.L.P., we have represented and won cases for numerous premises liability lawsuits. In 2013, Timothy McMahon, partner at Corsiglia McMahon and Allard, L.L.P., represented a college student who fell from a third-story window and obtained a $5.7 million settlement (Pacheco v. Spieker Co. Inc.). The property owner and managers were forced to retrofit all of their windows to prevent inadvertent falls from tenants and guests. This work likely saved other tenants from further injury.
Additionally, our firm is representing a San Mateo County client whose 18-month-old toddler also fell out of an open window (at floor level) and sustained devastating brain injuries. Following the fall, the owners and property managers were forced to install window guards to protect their tenants. Depositions in the case revealed that the owner was advised that his windows were unsafe for children and was warned to install different windows or guards by the contractor. The owner refused to take the advice of his contractor in order to save money. We are currently still pursing this case.
