Motor Vehicle and Motorcycle Accidents

In a rear-end motorcycle accident case that resulted in being named Trial Lawyer of the Year in 2018, Mr. McMahon represented the severely injured motorcyclist. The driver tried to blame the motorcyclist by first stating that the motorcyclist rear-ended her car then changed her story to blame the motorcyclist for lane-splitting and darting in front of her vehicle. Through painstaking investigative work, Mr. McMahon proved to a Santa Clara County jury that his client was the one who was rear-ended, which led to the jury awarding nearly seven-million dollars in compensation.

Trucking Accident

Mr. McMahon has represented many clients injured by negligent truck drivers and trucking companies. He also represents the loved ones of those killed in truck accidents. When a truck driver who was high on meth plowed into stopped traffic on a California highway, Mr. McMahan filed a wrongful death lawsuit when the truck driver killed his client's father. The case settled for more than $10 million after Mr. McMahon discovered that the trucking company engaged in dangerous and negligent employment and hiring practices, which is why they hired a meth addict as a truck driver.

Protecting the Families of Military Service Members and Law Enforcement Officers

When it comes to protecting those that put their lives on the line for us, Mr. McMahon’s track record includes ensuring compensation for the families of military service members and law enforcement officers injured or killed by the negligent acts of others.

The parents, wife, and two-year-old son of a 23-year-old US Marine who had just returned home from Afghanistan received a $3,250,000 settlement from the family of the drunk driver and the bar that overserved him. The Marine was killed while riding his motorcycle when struck by a drunk driver who was being chased by Fremont Police.

In Imperial County, Mr. McMahon secured a $1.675 million wrongful death settlement for the family of a retired Sunnyvale public safety officer killed as a result of the County being aware of and not fixing a dangerous roadway condition. The wrongful death lawsuit settlement led to roadway safety improvements.

Window Fall Cases

Mr. McMahon has also been successful in numerous windows fall cases. Most recently, Mr. McMahon secured $9,475,000 for a family whose 18-month old son died as a result of falling out of an unsecure and unsafe window in Foster City.

In a case involving a 16-month old toddler, Mr. McMahon secured nearly $5 million in compensation, asserting that the child suffered traumatic brain injury despite negative findings on a CT scan or MRI. The child survived the window fall from an unprotected, upper-level low-sill and bottom opening apartment window. Following the fall, the owners and property managers were forced to install window guards to protect their tenants.

In a 2013 window fall case, Mr. McMahon represented a college student who fell from a third-story window. He obtained a $5.7 million settlement and forced the property owner to retrofit all of their windows to prevent future inadvertent falls from tenants and guests. This case exemplifies the extent to which Mr. McMahon will go to bat for his clients. Even though his client was blamed for being intoxicated when she fell, Mr. McMahon stood by his client. He successfully argued that a person is not necessarily negligent because they use alcohol especially in the privacy of their residence and that the victim's fall was not caused by alcohol but rather by the negligence of the property owner installing windows that did not meet building codes.

Awards and Recognition

Super Lawyers have recognized Mr. McMahon since 2008. He was also selected as the 2013 and 2018 Santa Clara County Trial Lawyer of the Year along with a Street Fighter of the Year finalist in 2010 by the California Consumer Attorneys. Mr. McMahon is a proud member of the Irish Legal 100 which recognizes the top 100 Irish American Attorneys in the United States and has also been included in The National Trial Lawyers Top 100 in California since 2012. Mr. McMahon graduated from the University of California at Santa Barbara in Pharmacology with High Honors. Before attending law school, he worked with physicians and scientists at a research hospital studying the biochemical effects of diabetes and other diseases. Mr. McMahon subsequently attended the University of Santa Clara School of Law where he earned his Juris Doctor (J.D.), graduating Magna Cum Laude and in the top ten of his class. His detailed knowledge of medicine and biochemistry is well known among his colleagues and is possibly unique in the field of personal injury.
