The Tragic Impact of a Bus Accident

Bus AccidentPublic and mass transit provide numerous benefits to society, including the reduced impact on emissions and overall cost-effectiveness. Unfortunately, those benefits seem to come at a steep price. Per registered vehicle, buses and other commercial vehicles have a higher risk of fatality than other passenger vehicles. Furthermore, the risk is not just for the passengers themselves, but also for pedestrians, motorcyclists, and bicyclists, who are all too often victims in bus crashes. Because this risk for tragedy exists, every road user should know their rights.

Recent Accident Highlights the Capacity for Fatality

In the early morning hours of October 23, a USA Holiday bus crashed into a slow-moving tractor-trailer near Palm Springs on Interstate 10. A total of 13 passengers were killed, and another 31 were injured, four of which are currently in critical condition. An investigation as to why the crash might have occurred is ongoing, but authorities say there is currently no indication that the driver had applied the brakes before smashing into the truck. No skid marks were found.

This tragedy highlights just how massive the impact of a bus accident can be. Certainly, passenger vehicle crashes can be just as devastating to those who are affected. Yet it is the numerous passengers that creates the serious and concerning propensity for mass harm, grief, and pain.

Transit Vehicles Have a Safety Obligation to the Public

Because they are responsible for safely transporting numerous passengers at once, bus and other commercial transit vehicles are held to a higher standard. They, and their drivers, must comply with certain rules and regulations, including restrictions on how long a driver can be behind the wheel. Further, they can be held liable when they neglect to follow the imposed regulations. This includes cases in which a driver or bus company’s actions or inaction causes the wrongful death of a passenger or another road user.

Getting the Compensation You Deserve

If you or someone you love has been injured or wrongfully killed in a bus or transit accident, it is critical that you seek skilled legal assistance with your case. This is due, in part, to the regulatory guidelines that govern bus and other commercial vehicles, but it is also because there may be multiple negligent parties involved. A full investigation, which can be done by your lawyer, can ensure that all responsible parties are held liable for their part in the death or injury of your loved one.

At Corsiglia, McMahon & Allard, L.L.P., we fight for the rights of accident victims and their families. I absolutely cannot speak highly enough of CMA Law, particularly of Mr. McMahon, with whom I have had the most experience. My entire family and I trusted CMA with our case following a significant and life-altering vehicle accident, and to say they delivered is putting it lightly. They were reachable & personable at every stage of this arduous, complex, and scary process, made things easier at every stage, inspired us with confidence, and delivered results. If you're looking for a law firm to place the trust of you in your family in, look absolutely no further than CMA - this is your firm. Declan O.

I suffered a severe spinal injury while working as a farm mechanic in the Salinas Valley. The attorneys -Tim McMahon and Mark Sigala were fantastic from the beginning. They fought for me over 3 long years and in the end, we won a difficult liability case against the farm company who was using dangerous equipment. The defendants in the case tried everything to put the blame on me and even claimed I was their employee in order to avoid civil responsibility. Tim and Mark never gave up on me and my case. I cannot recommend them highly enough. They are fighters. Adrian A.
