San Jose elder abuse lawyerMore and more individuals are requiring the help of nursing homes. In fact, one study suggests that more than half of all Americans will need to stay in a nursing home at one point in their life. Unfortunately, many nursing homes cannot keep up with the number of people needing care. This has led to an unacceptable number of understaffed and grossly inadequate facilities.

Studies Show a Shocking Number of Elders Are Being Mistreated

Elderly individuals should be the most well-treated members of our society. Sadly, many older people find themselves in nursing homes which do not take their needs seriously or worse, purposely hurt them. Incidents of nursing home abuse and neglect are not isolated to only a few facilities. One congressional report showed that of all U.S nursing homes, nearly a third were guilty of violations which put residents in danger. Surveys show that an astounding 44 percent of nursing home residents report being abused while staying in a nursing home. Even worse, a whopping 95 percent of nursing home residents say that they have personally witnessed nursing home staff neglect other residents.

What Does Nursing Home Abuse and Neglect Look Like?

It can be incredibly difficult to know when nursing home residents are being mistreated. Many older people have cognition or memory issues which make it nearly impossible for them to report the abuse. Other residents have physical incapacitations that make it difficult for them to communicate mistreatment to their loved ones. Neglectful behavior can include staff not providing enough food or water to residents, inadequate hygiene practices, not administering the correct medication or delaying medication, improperly treating wounds or injuries, and isolating residents from others.

Tragically, some people take advantage of the frail nature of nursing home residents and purposely harm them. Nursing home abuse includes physical violence like hitting, slapping, or kicking as well as the overuse of restraints or using excessive force against a resident. Other times, abuse against a resident is sexual or financial in nature. Psychological abuse can be incredibly damaging to a nursing home residents’ psyche and includes threatening, humiliating and demeaning behavior toward the resident.
