Child Window Fall Brain Injury Case Results in Nearly $5 Million Settlement
Attorney Timothy McMahon secured a near five-million-dollar settlement for an 18-month-old child who fell out of a Redwood City apartment window and suffered a brain injury. The case took nearly eight years to resolve before the defendants paid a total of $4,965,498.
The then young child fell from an unprotected, upper-level low-sill, bottom-opening window at The Beech Street Apartments in Redwood City. The plaintiffs alleged that the property owners and the manager were negligent for failing to maintain a safe apartment building and that the window installers knowingly installed dangerous windows.
The windows were authorized by the property owners and installed with only a window screen separating the room's interior from the outside, creating a dangerous condition.
The window installers were the first to settle, tendering the remainder of their $1 million insurance policy, which amounted to $965,498.51. Following mediation a few months later, the remaining defendants agreed to a total $4 million settlement bringing the total settlement amount for the child to $4,965,498.51.
