Only five percent of the lawyers in the state are honored and named by Super Lawyers.

McMahon and Allard, along with partner Brad Corsiglia, have positioned the personal injury law firm of Corsiglia McMahon & Allard, L.L.P. as one that wins tough cases where insurance companies and corporations offer little or no money to an injured victim.

Timothy McMahon continues to pursue and win cases against corporate interests. Earlier this year, McMahon forced the owners of a large hotel chain to pay more than one million dollars in damages due to their negligence in failing to provide a safe work place and not procuring Workers’ Compensation insurance. The hotel chain had a practice of paying their employees cash and not providing Workers’ Compensation insurance. In California, an employer can be sued directly by his employee, if the employer failed to obtain Workers’ Compensation insurance. This is true even if the injuries were primarily caused by the negligence or intentional conduct of third parties. McMahon’s client, a foreign citizen, was working without a visa and the owners were aware that he was an undocumented worker. The client, working as a night clerk, was summoned to a scuffle at a room in the hotel at 2:00am. He was attacked by guests when they were asked to keep the noise to a minimum. The plaintiff was rendered unconscious and spent almost four weeks at a local county medical facility with various broken bones, teeth, and a head injury. The attackers were eventually convicted of attempted murder and are serving lengthy sentences within the California state prison system.

In another case, McMahon successfully sued an upscale spa facility that allowed a recently released felon from San Quentin to perform massages. The felon, on parole, and during his first day of work, inappropriately touched McMahon’s client. The facility knew the felon’s background, that he was not fully trained, and that he did not have the proper licenses, but because they were short on staff hired him– despite his lack of qualifications. The masseuse was eventually returned to San Quentin following his arrest and capture two days after the incident. The case resolved short of trial for a confidential sum.

Allard was named 2009 Santa Clara County Trial Lawyer of the Year for the second time in three years as a result of winning four cases that started with little or no monetary offers and ended with well over one million dollars in each case for his clients. He was named as a Top 100 Trial Lawyer in California by The American Trial Lawyers Association.

In a case involving a minor impact car accident against an Allstate insured, Allard secured $1.25 million. The case involved an accident wherein the plaintiff’s car was struck from behind by a vehicle traveling an estimated 10 miles an hour. “Science was totally against me,” said Allard. “All of the literature says that it was virtually impossible that these type of forces could cause the type of injury my client had,” stated Allard. So through his experts Allard had to prove his case medically and demonstrate that minimal forces caused his client’s injury.

In another case, Allard obtained a $2.056 million arbitration award for a public school behavioral specialist who was seriously injured in a head-on car crash while traveling on a school field trip. Despite a clear case of liability, horrific injuries and hundreds of thousands of dollars in medical bills and lost wages, the school district’s relief fund never offered a penny in settlement and resorted to fighting the victim every step of the way.

Allard ended 2009 by securing a confidential financial settlement against an area bank that was in the best interest of the victim’s family and should result in better security for both customers and employees following the death of one of its customers.

Allard is currently in litigation against USA Swimming, Pacific Swimming and San Jose Aquatics (Santa Clara County Superior Court, Case #109CV149813) as a result of alleged sexual molestation committed against young teenage females by San Jose Aquatics swim coach Andrew King. As the national governing body, USA Swimming is responsible for selecting and training teams for international competitions including the Olympic Games.
